Judge Pedraz reverses decision and temporarily halts Telegram blockade

Judge Santiago Pedraz has requested a report from the General Information Commissioner before deciding to block the Telegram messaging platform in Spain. The magistrate intends to understand the exact characteristics of Telegram and how a temporary suspension may impact its users. The ruling by the National Court judge does not provide any further details about the new deadlines or what to expect from this report from the General Information Commissioner’s Office.

The announcement of the suspension of Telegram on Friday night caused a stir among its more than eight million users in Spain. Other countries have tried but failed to limit a platform like Telegram, with much of its content linked to dissident activities in undemocratic or directly illicit or illegal countries.

The initial measure to block Telegram was taken at the request of Mediaset, Atresmedia, and Movistar Plus, who accused the application of sharing copyrighted content on some of its channels. The judge of the National Court, Santiago Pedraz, issued an order that operators suspended resources associated with Telegram within three hours of receiving it. However, as of Monday morning, operators consulted by EL PAÍS had not received any notification.

Telegram is an instant messaging application launched in 2013 and directed by Russian-born businessman Pavel Durov. Since its inception, it has stood out for user privacy and freedom over other messaging platforms like WhatsApp that share user data with authorities. This made it popular among dissidents in authoritarian regimes such as Russia or Iran, where it was used for organizing protests. However, it also led to channels for sensitive content flourishing due to its anonymous nature: drug sales, far-right activities, disinformation campaigns dissemination violent content and child pornography or terrorism. Without further elaboration, ISIS claimed responsibility for the Moscow attack on Friday through their Telegram channel.
