Mercadona has been accused of deceptive advertising by Facua-Consumers in Action, who reported the company to the General Directorate of Consumption for misrepresenting the composition of their product called Farmer 51% Oatmeal Tortillas. The association claims that the product only contains around 21% oat flour, not the 51% as advertised.
Facua has conducted an investigation into the composition of the product and found that it actually contains about 42% cereal flours, with only 21% oat flour. The organization believes that consumers may be misled by the name of the product, which suggests that oats make up more than half of the ingredients, when in fact they do not.
The association is demanding that Mercadona withdraws the product from the market until its distribution chain changes its name to reflect its true composition. They believe that labeling and presentation of goods should not mislead consumers, as stated in consumer protection legislation.
Facua has also requested that the Ministry of Social Rights, Consumption, and Agenda 2030 open a disciplinary file against Mercadona for misleading advertising and unfair competition. They are asking for the product to be withdrawn from stores until its name is changed to accurately reflect its composition.
Mercadona has yet to respond to these allegations or demands from Facua-Consumers in Action.
