The Spanish Labor and Social Security Inspection Launches Campaign to Investigate Trial Period Violations

The Labor and Social Security Inspection will soon launch a campaign to investigate potential non-compliance with trial period regulations in employment contracts, as reported by Cadena SER. The department, led by Yolanda Díaz, is concerned about companies exploiting the trial period and delaying termination until the last days before it ends. This could result in employees being subjected to multiple trial periods, which may be fraudulent.

According to sources within the organization, the aim of the campaign is to specifically target contracts that are terminated despite exceeding the maximum trial period duration, as well as dismissals of employees who have previously completed the same tasks without exceeding the trial period. Inspections will also focus on cases where employees are subjected to a new trial period for the same functions.

It is important to note that once the trial period ends, the employee is entitled to a settlement but not compensation. This means that companies must adhere strictly to the regulations regarding trial periods to ensure fair treatment of employees and compliance with labor laws.

The Anti-Fraud Tool will be used by the Labor Inspection to identify irregularities and prevent companies from exploiting the trial period to undermine workers’ rights and fair competition. Despite concerns about fraudulent use of the trial period, a majority of trials have been successfully completed since labor reform came into effect. Companies should take this seriously and avoid any actions that may violate labor regulations or harm their employees.

In conclusion, it is crucial for companies to understand their obligations when it comes to trial periods under Spanish labor laws. Failure to comply with these regulations can result in serious consequences for both employers and employees alike, including legal action against companies found guilty of fraudulent behavior or unfair treatment of workers.
